Warrant Issuance Rules for Douglas County

Every warrant issued in Douglas County must follow Minnesota state law. Under Minn. Stat. 626.05, a search warrant is defined as a written court order directed to a peace officer. It commands the officer to search a particular person or place and seize specific items. The warrant must be signed by a judge with jurisdiction over the county where the search will happen.

Probable cause is the foundation. Under Minn. Stat. 626.08, no search warrant can be issued without probable cause supported by a sworn affidavit. The affidavit must describe with particularity the person to be searched, the place, and the items to be seized. This prevents overly broad warrants and protects the rights of Douglas County residents.

Once issued by a Douglas County judge, a search warrant is good for 10 days. If officers do not execute it within that time, the warrant becomes void under Minn. Stat. 626.15. Financial institution warrants are an exception and get 30 days. Arrest warrants, on the other hand, do not have an expiration date. They remain active until the person is arrested or the court recalls the warrant.

Douglas County in the Statewide Warrant Network

Like all Minnesota counties, Douglas County shares its warrant information with the statewide criminal justice data network. Minn. Stat. 299C.115 requires every county to make warrant information available to law enforcement through the BCA system. This includes data on all outstanding felony, gross misdemeanor, and misdemeanor warrants for adults and juveniles.

The Bureau of Criminal Apprehension manages the central warrant file. Douglas County feeds its data into this system. If a person with an active Douglas County warrant gets stopped in another part of the state, the officer can see the warrant through the BCA network. This statewide sharing means you cannot simply avoid a warrant by leaving the county.

For those looking at criminal history rather than active warrants, the BCA offers a public search at cch.state.mn.us. This tool shows conviction records but not current warrant status. It is free to use and only requires a name and date of birth.
