How Nobles County Warrants Are Issued
The process starts when an officer wants to search a place or arrest someone. They write up the facts in an affidavit and bring it to a judge. Under Minn. Stat. § 626.07, there are five specific grounds for a search warrant: stolen property, crime tools, contraband, items held to commit a future crime, and evidence. No other grounds exist under state law.
Search warrants in Nobles County must be served between 7:00 AM and 8:00 PM. Under Minn. Stat. § 626.14, the judge can approve night service, but the affidavit has to positively state that the items are there. No-knock warrants require the strongest showing of all. Officers must prove that someone inside is an imminent threat and that the search cannot wait.
Under Minn. Stat. § 626.15, search warrants expire after ten days. The officer must serve and return the warrant to the court within that time. Arrest warrants in Nobles County do not expire. They remain active until the person is found or the court pulls the warrant back.
